In New York State, if you are caught with a small amount of heroin, you will be charged with the misdemeanor criminal charge of “criminal possession of a controlled substance in the seventh (7th degree).” If you possess 1/8 ounce or more of heroin, you will be charged with “criminal possession of a controlled substance (5th)” which is a D felony. If you have one (1) ounce or more, you will be charged with a C Felony and if you possess two (2) ounces or more a B Felony. If you are attempting to sell any amount it is a B Felony. If you possess over four (4) ounces you will be charged with an A Felony. The standard penalty for a first time, non-violent offender convicted of a class D felony would be up to 7 years in prison.
