In New York State, if you are caught with a small amount of heroin, you will be charged with the misdemeanor criminal charge of “criminal possession of a controlled substance in the seventh (7th degree).” If you possess 1/8 ounce or more of heroin, you will be charged with “criminal possession of a controlled substance (5th)” which is a D felony.
